Yes, as it's the Release Candidate and offered as a free download. It's basically trial ware at this point.

"The RC is free and will be available at least through July 2009. However, because Microsoft isn't providing technical support for the the RC, we strongly recommend that only experienced computer users sign up. How experienced? At minimum, you should be comfortable backing up a computer, formatting a hard drive, burning an ISO file to DVD, and installing an operating system from scratch. You should also be comfortable troubleshooting problems on your own."

Free is the key word.

I wouldn't do that - I'd restore the factory OS.

If you read the license agreement for the RC you'd probably find wording that says the license is to you and is not reassignable. I'd also be concerned about any problems the buyer had. It's simple enough for the buyer to load Win7 him/herself.

Steve, I looked around before posting my previous post and found nothing resembling a EULA, just a Privacy Statement. If you have a link to something else, I'll happily delete my other post.

The official EULA isn't online yet.

I haven't done a clean install of W7 in a while, so I'm not sure what it says during the install. Pretty sure I remember seeing some sort of EULA though.

The other issue is that the person you're selling this to is going to need to buy a copy of W7 to use once it gets past the trial period (and starts shutting itself off automatically). Make sure they know this ahead of time.

Unless you want to support the machine every time they hit a snag, (W7 is still in testing after all), I wouldn't do it, but the choice is ultimately yours.
